We, Moloco, Inc., provide this Website Privacy Notice (“Notice”) to explain how we collect, use, disclose, and otherwise process personal information when you use https://www.moloco.com/ and related sites, including business client portals, interact with our emails (collectively, “Sites”), and otherwise directly communicate, interact, or share personal information with us. This Privacy Notice also describes rights and choices you may have with respect to how we and our advertising providers process your personal information, including with respect to Tracking Technologies (as described further below).

An Important Note: Except as described here, this Privacy Notice does not apply to any personal information we collect from or on behalf of our business customers who have engaged us to provide online products and services, including Moloco’s advertising platform services (collectively, our “Business Services”). Our Sites and Business Services are intended for business customers, and are not directed to consumers or minors under 18 years of age (or the age of majority established by local law). We do not knowingly collect personal information from minors.

Personal information we collect

Information you provide to us:

Account information

If you create an account with Moloco to obtain Business Services, we will collect various categories of personal information such as your name, email address and other contact details, organization, and your activities associated with your account.

Your communications with us

We may collect personal information from you, including your name, email address and other contact details, and organization, when you use our Sites, request information about or a demo of our Business Services, sign up for Moloco marketing, register for our newsletters and events, inquire about an opportunity to collaborate, participate in Moloco surveys, request customer or technical support, or otherwise communicate with us.

Interactive features

Our Sites may include interactive features such as service reporting, content creation, blogs, and social media pages. We and others who use our Sites may collect the information that you submit or make available through these interactive features. Any content you provide on the public sections of these features will be considered “public.”

Automatically Collected Information:

Automatic data collection. We may collect certain information automatically when you use our Sites or interact with our emails, including your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile advertising and other unique identifiers, details about your browser, operating system or device, location information (including inferred location based off of your IP address), Internet service provider, mobile carrier, pages that you visit before, during and after using our Sites, information about the links you click, information about how you interact with our Sites, including the frequency and duration of your activities, and other information about how you use our Sites.

Cookies, pixel tags/web beacons, and other technologies.

We, as well as third parties that provide content, advertising, or other functionality on our Sites, may use cookies, pixel tags (also known as web beacons), local storage, and other technologies (“Tracking Technologies”) to collect the types of information described above as information that is collected automatically. Tracking Technologies include small data files placed on your device and other mechanisms that, depending on your settings and consent preferences, allow us and our advertising providers to record certain pieces of information whenever you visit or interact with our Sites or emails, and online services within the networks of our advertising providers.

  • Cookies. Cookies are small text files placed in device browsers to help recognize information about the user and store information about them, such as their preferences. Most browsers allow you to block and delete cookies. However, if you do that, our Sites may not work properly.
  • Pixel Tags. A pixel tag is a piece of code embedded in our Sites that collects information about engagement on our Sites. The use of a pixel tag allows us and potentially our advertising providers to record, for example, that a user has visited a particular web page. We may also include pixel tags in e-mails to understand whether messages have been opened, acted on, or forwarded.
  • Local Storage. Local storage is a browser storage mechanism that lets a website store data locally in the user’s browser.

How we use your information

We may use your personal information for a variety of business purposes, including:

  • Fulfilling our contract with you;
  • Responding to questions, comments, and other requests;
  • Allowing you to register for events;
  • Providing access to certain areas, functionalities, and features of our Sites; and
  • Answering requests for customer or technical support.

  • Pursuing our legitimate business objectives, such as research and development (including marketing research), network and information security, and fraud prevention;

We and our advertising providers may, depending on your preferences and consent settings, use Tracking Technologies to automatically collect the information described above, make inferences about your interests and preferences, and tailor our online advertisements to you.

Use of de-identified and aggregated information

We may use personal information and other data about you to create de-identified and/or aggregated information, such as de-identified demographic information, de-identified location information, information about the device from which you access our Sites, or other analyses we create.

Share content with friends or colleagues

Our Sites may offer various tools and functionalities that allow you to share content with your friends and colleagues and refer them to us as potential contacts. Please ensure that you have your friend or colleague’s consent before providing their personal information to us using our Sites.

Disclosing your information to third parties

We may disclose your personal information to the following categories of third parties:

Moloco customers

If you access our Sites as an authorized user of one of Moloco’s business customers, the Moloco customer may access information associated with your use of the Business Services including usage data and the contents of the communications and files associated with your account. Your personal information may also be subject to the Moloco business customer’s privacy policy.

Service providers

We may disclose personal information to our third-party service providers. The categories of service providers to whom we entrust personal information include service providers for: (i) the provision of our Sites; (ii) the provision of information, products, and other services you have requested; (iii) marketing and advertising; (iv) payment and transaction processing; (v) customer service activities; and (vi) the provision of IT and related services.

Advertising providers

We may allow third-party advertising providers to use Tracking Technologies to collect the types of information described above under “Automatically Collected Information.”. We and our advertising providers may, depending on your preferences and consent settings, use this information (and similar information collected from other online services) for purposes of delivering targeted advertisements to you when you visit third-party services within our advertising providers’ networks.

Disclosures to protect us or others

We may access, preserve, and disclose any information we store in association with you to external parties if we, in good faith, believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) protect your, our, or others’ rights, property, or safety; (iii) enforce our policies or contracts; (iv) collect amounts owed to us; or (v) assist with an investigation and prosecution of suspected or actual illegal activity.

Disclosure in the event of merger, sale, or other asset transfer

If we are involved in a Business Transaction, then your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

Your choices

Tracking Technologies

You may control the use of Tracking Technologies on our Sites by clicking “Your Privacy Choices” in the footer of our website and following the prompts. In addition, you may restrict the placement of cookies or remove them using your browser-level or device-level controls.

The online advertising industry provides websites from which you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. Email communications

If you no longer wish to receive marketing emails from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. We may also send you certain non-promotional communications regarding us, our Sites, and our business, and you will not be able to opt out of those communications (e.g., communications regarding our transactions with you, or updates to our Terms of Service or this Notice).

Your privacy rights

In accordance with applicable law, you may have the right to: (i) request confirmation of whether we are processing your personal information; (ii) obtain access to or a copy of your personal information; (iii) receive an electronic copy of personal information that you have provided to us, or ask us to send that information to another company (the “right of data portability”); (iv) object to or restrict our uses of your personal information; (v) seek correction or amendment of inaccurate, untrue, incomplete, or improperly processed personal information; (vi) withdraw your consent; and (vii) request erasure of personal information held about you by us, subject to certain exceptions prescribed by law. We will process such requests in accordance with applicable laws. To protect your and others’ privacy, we may take steps to verify your identity before fulfilling your request.

Data retention

We store your personal information for as long as necessary to fulfill the purpose(s) for which it was collected (as set forth in this Notice and other privacy notices we may have furnished to you), provide our Sites, resolve disputes, establish legal defenses, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

Third party websites/applications

Our Sites may contain links to other websites/applications and other websites/applications may reference or link to our Sites. These third-party services are not controlled by us. We encourage you to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such other websites or applications.

Changes to our privacy notice

We may revise this Notice from time to time in our sole discretion. If there are any material changes to this Notice, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Notice if you continue to use our Sites after the new Notice takes effect, unless we are required to obtain your acceptance or consent in a different manner.
